Supreme Court Seeks Income Tax Department's Response to NewsClick's Plea Against Tax Demands

Last updated: 13 July 2024

In a significant development, the Supreme Court of India has sought the response of the Income Tax Department to a petition filed by NewsClick against two income tax notices. This decision was reported by Bar and Bench. The Bench comprising Justices BV Nagarathna and Dipankar Datta also issued notice on the application filed by the news portal for interim relief.

Supreme Court Seeks Income Tax Department s Response to NewsClick s Plea Against Tax Demands

Background of the Case

The legal battle between NewsClick and the Income Tax Department has been ongoing, with the current petition marking the second round of litigation before the Supreme Court. The Delhi High Court had previously rejected NewsClick’s plea for relief in November last year, leading the news portal to approach the apex court.

Legal Journey

Earlier this year, in February, NewsClick decided to withdraw its petition from the Supreme Court to seek relief from the Income Tax Appellate Tribunal (ITAT). However, on April 5, the ITAT refused to stay the tax demands. This decision was subsequently upheld by the Delhi High Court on May 10, which prompted NewsClick to file the current appeal before the Supreme Court.

Observations by the High Court

In the first round of hearings, the Delhi High Court noted concerns regarding NewsClick's financial dealings, stating that there was no prima facie case in favor of the news portal. This observation has added complexity to NewsClick’s legal strategy and has been a point of contention throughout the proceedings.

Current Proceedings

During the hearing, NewsClick’s counsel highlighted the financial difficulties faced by the portal, including challenges in paying employee wages. The Supreme Court's decision to seek a response from the Income Tax Department marks a critical point in this ongoing legal saga, potentially setting the stage for significant developments in the weeks to come.

Implications

The outcome of this case could have broader implications for media organizations and their interactions with tax authorities. It underscores the ongoing scrutiny and legal challenges faced by media entities in India, particularly concerning their financial and operational transparency.

Looking Ahead

As the Supreme Court deliberates on the matter, stakeholders from various sectors will be keenly observing the proceedings. The response from the Income Tax Department and the subsequent decisions by the Supreme Court will be pivotal in determining the future course of action for NewsClick.
