In a private company if a director is in whole time employment of the company,should he be complulsorily appointed as Whole Time Director of the Company. Just being in whole time employment does he becomes whole time director and necessary ROC form has to be filed for it?
No although all Executive Directors are Whole time Directors but they will be considered as Whole Time Directors only if they are designated as Whole Time Directors. On being appointed as WholeTime Director they will come under the category of "Managerial Persons".
