Which ITR form to submit?

Hi,

For last financial year I was a freelance for some months and then was employed (on payroll) for rest of year. for the months I was a freelancer I have paid some advance tax. I also have some short term capital gains of less than 1lakh.

Which ITR form should I be filing for my IT returns.

Thanks in advance

Quick Summary
If you've worked as a freelancer and an employee within the same financial year, and also have capital gains, you'll likely need to file ITR 3. While ITR 4 might seem simpler, it doesn't accommodate capital gains. Freelancers eligible for presumptive taxation under Section 44ADA can often use ITR 4, but the presence of capital gains necessitates the use of ITR 3 for accurate reporting.

File ITR 3

Claim your income u/s 44ADA.

File under presumptive taxation u/s 44ada
Selection of return is based upon the following :
1. Nature of assesse
2. Quantum of income.
3. Source of Income.
ITR4 if you are eligible to opt for 44ADA else ITR3.
What is your Income and for which assement year.

assessment year is AY 2021-2022

total income from salary and freelance is less than 50 lakhs

how to determine eligibility for 44ADA

in terms of filling the form - is it easier to file ITR 4 compared to ITR 3?

What's the nature of service?

worked as contractor (software consultant) for an IT company

Then you can opt for 44ADA.

But I think I missed a point here. Since you have capital gains, ITR4 cannot be used. ITR3 would be the appropriate form.

thanks everyone for your responses. I guess ITR 3 it is

ITR 2 IS SUFFICIENT.
