Which income tax return should be filed ?

Respected Senior Members and my dear fellow mates,

I have a question regarding the form of Income Tax which is to be filed in the below mentioned circumstances :

A person having income from his own proprietorship business and he is also a partner in a partnership firm form where he gets (i) salary and  (ii) share of profit. Then which Income tax return he should file.

I believe ITR - 3 is for partners in firms and not carrying out business under any proprietorship and WHEREAS   in ITR - 4 although there is provision called Schedule - IF where we can mention the amount of share in the profit of the business of the firm but not the salary withdrawn.

Then which ITR should be filed ? Thank you everyone in Advance for your expert replies.

Itr 4 will have to be filed

Itr 4 will have to be filed

ITR-4 is the appropriate form.

Yes acc. To your details. You should go for ITR4

Thank you for your replies. But please tell me the Schedule/provision where the salary (not the profit) which has been withdrawn by the partner can be placed ?

Schedule S in ITR-4 relates to income from Salary. You can place it there.

ITR4- Schedule S- Details of Income from Salary

I humbly disagree with Sri Amitav.  Please use Form ITR-4.

(1) See Schedule BP and item No.24.  Here enter the proportionate share of the partner in the salary claimed by the Firm in its ITR.

(2) Schedule IF

(3) Schedule EI

Agreed with you K. George Philip...Thanks a lot.
