Which category i will consider the short sale loss in itr?

I have done intraday trading and also done shorting in which i sell stock first and then buy them back on the same day.

However, in one scenario, i sold 500 stocks of one particular company and then was able to buy only 300 on the same day.

But as per the rules, This situation is called "Short Delivery". The penalty amount is around 20% of the stock price. So i paid the penalty and buy the stock on next trading day at higher price.

So should i consider the loss on 200 stocks as intraday loss or short term loss? Thanks.
