Dear All,


My new client's all previous sales tax & income tax returns and also sale & purchase bills for prevous three years is with his old CA. He refused to return the document to Client. My client paid all the dues of CA. Please suggest what should i do.

just lodge a complient with the icai if you are confident about yourselves.

He should be having any valid reason for the holding back the documents... I think try and talking to the CA should settle the issue...

This a professional misconconduct, you can lodge a complaint against such CA if he is not correct on his part.

ya its better to have a talk to resolve the matter.... i advise not to go 2 icai for complaint

Actually speaking if that Auditor is not giving back the books pertains to your new client.  Just have a chat with Auditor individually and also convey your outcomes to your new client.  If the matter is with regard to any professional reason, have a discussion so deeply with the old Auditor.  Then have a discussion with your new client and also with the old Auditor.  Try to sort this issue before lodging a complaint against the Auditor to Institute.  You will come know the reason for not giving the information only when you speak to the old Auditor.   If nothing comes fruitful lodge a compliant, but before lodging check yourself about  the correctness of the complaint, your new client should be fair enough.

I Have a private Limited Copany and I Need to have Statutory Audit and Tax Audit Reports for ROC Filing and Submission to Bank for having taken of loan Rs 8Crores.  MY Auditor despite several request has not given Tax Audit Reports, 3CA-3CD Papers for 07-08 and for 08-09 Years ... What Should I do ??? Is there a grievance cell to lodge a complaint. 

I Have no dues to him on his remuneration part still the issue drags on..and he has taken up corporate job as VP finance  in an organisation leaving the practice Can he issue the Tax Audit papers of those years mentioned above

Mr. Sridhar sir you can lodge a complaint with ICAI...the auditor does not have any right to have possession of your records.

Ask the reason. He dont have any right to possess your books of accounts.

If he dont give any appropriate answer, just complaint to ICAI.

Its a serious proffesional misconduct.
