I am a service provider and registered with the Service Tax Authorities. I have paid taxes till present but have not filed the return in ST 3. Now I am liable to the penalty, if the officer decides to levy it.  How much will the penalty amount be if returns filed are from 01st April, 2010 onwards till now. Also, am i eligible to apply for VCES and would it be a good idea to go for it.

In my view you cannot eligible for VCES further, if you could not deposit your Service Tax Return in this regard you may be face the penalty procedure. The penalty procedure i.e.

Delay of 2 days Rs. 500/-

Delay of 20 days Rs. 1000/-

Delay of 35 days Rs. 1000/- + Rs. 500/- @ 100 per day=Rs. 1500/-

Delay of 40 days Rs. 2000/-

Delay of 365 days Rs. 20000/-

So I CAN or CANNOT apply for VCES?

You are already registered with Service Tax Department a long period, further a fresh registration required in the VCES.

sir, i want to ask a query related to VCES, 2013, If we deposited the tax dues amount before submitting the VCES-1 to designated authority, now can we take the claim of deposited amount in VCES scheme?? plz tell me sir
