Vat benefit items procured from govt

Dear Expertz,

We purchased Electrical Transformer from APTRANSCO, VAT charged by APTRANSCO and also we are procuring some WOOD from Forest dept., VAT charged by forest dept., the both are not having TIN no.

please clarify can we claim ITC benefit on above purchases?

  APTRANSCO is a public sector company and they must be having a TIN no.Forest departments in each state keep selling many forest products in auction.They collect vat in all such sales.Similarly all state and central govt departments,corporations,civic bodies and PSUs have been directed to collect vat and st as applicable in their invoices.None of them have any vat or cst registrations.The invoices issued by them will be enough to claim ITC.But,this ITC claim is possible for only within the state buyers and not interstate customers.....mjk

Thank you very much for your reply,

we are from Andhra Pradesh, our local authorities are denying ITC on the above purchases saying without TIN no you cannot claim ITC benefit.

Please advise how can we protest our ITC on the above?
