Respected Experts, Please suggest on the following:

Three Individuals wish to Incorporate a LLP. In LLP form, there is an option:

"Whether the proposed name is based on a trademark registered or is subject matter of an application pending for registration under the Trade Marks Act?"

This Proposed LLP wants to use a Trademark. And This trademark is already applied for registration by some other Individual and Status is showing "Objected".

Now in above LLP Form, what is to be done?

Corrective Action: The applicant can overcome this objection by requesting to correct trademark application by filing a request on form TM -16.

Instead of Correction, Can LLP (Post Incorporation) apply for Registration of that Trademark in its own Name?
