My employer not filing TDS returns from past 3 years.

 

Because of this I received Demand notices u/s143/(1) even though TDS deducted from my salary.

What to do ?

Just lodge a complaint against your employer... If he is deduction tds from your salary and not paying it too government.he is in big default

My employer is depositing the tax deducted ,but not filing quarterly TDS returns

Just try to get your employer rods deposit slip... and than send a xerox copy on reply of notice you received...

Where is your salary slip? Send the copy of the salary slip to your AO showing the TDS deduction and request them to give you tax credit. Fighting with your employer while you continue to work there isn't such a good idea.

Do you have form16? Payslip? or any such document which has proof that employer has deducted TDS.

 

In recent judgement Tribunal has said that Tax credit is allowed even if it is not credited to 26AS.

So you have to reply to notice with any of those proofs.
