Unlisted shares in itr2 - multiple purchase dates in fy2018-19

Hi,

In AY2019-20 ITR2, I understand that we have to declare unlisted shares, their face value and date of acquisition. I have to report unlisted shares (foreign company) of the same company purchased on multiple dates with different fair market values.

How to do that in the JAVA ITR2 utility? I have not sold any of them in FY2018-19.

You can declare opening balance of total shares (of each scriptt) as on 01.04.2018, with average cost of purchase; no need to declare separately.

Should I also declare the ESOPs granted by my employer as part of compensation as unlisted shares? If yes, would I have to declare both vested and unvested or only vested?

Only Vested.

I have an extension to above question. I understand that we can show the Opening balance and Average Cost of acquisition to start with. However, what if we got shares of the same company multiple times in last FY? How do I show closing balance for each line item because Opening balance is shown in first row only. If I got 100 shares worth 100,000 rupees in opening balance and received 150, 200 and 300 shares on 01 May 2018, 01 Sept 2018 and 31 Dec 2018 worth 150,000, 400,000 and 750,000 rupees, how do I show consolidated closing balance. All these shares belong to the same company, hence I cannot have opening balance in multiple rows. Similarly, I believe I cannot have closing balance in multiple rows (how do I show aggregated here). Any guidance will be greatly appreciated.

In the latest circular, IT has clarified about reporting of unlisted shares. For people who have ESPP/RSU shares from foreign company, following would be relevant

Question.4: I have held shares of a company during the previous year, which are listed in a recognized stock exchange outside India. Whether I am required to report the requisite details against the column “Whether you have held unlisted equity shares at any time during the previous year?”

Answer: No.

 

Now, what foreign stock exchanges are recognized. For example, is NASDAQ or NYSE of USA considered recognized as per Indian IT laws?

Yes, but the reply is for any shares unlisted ONLY in foreign exchange. If listed in any of Indian exchange earlier, they are excluded in the query.

 ESOP Allocation Price Rs 10
Allocation Date: dec, 2008

At the time DEMAT of the shares in July 2015, shares valuation was Rs 800. I paid Rs 10 for transferring the shares and in addition paid tax on Rs (800-10)=790

 

Please suggest what should I enter in ITR 2 for cost of acquisition: Rs 10 or Rs 800 of Rs 790.

FMV as on the date of exercise of the option.... i.e. Rs. 800/-
