For an NGO or charitable trust to get 80G(5) registration (now called provisionally registered first, then confirmed after 3 years), here is the process:

Registration under Section 12A or 12AB is a prerequisite: Your entity must first be registered under Section 12A (older trusts) or obtain provisional Section 12AB registration before applying for 80G(5). You cannot apply for 80G without 12AB being in place.

Application process:
- File Form 10A online on the Income Tax portal for provisional 12AB registration.
- After provisional approval (3 year validity), apply for 80G registration using Form 10AB at the same time or separately.
- Submit: trust deed or MOA/AOA (for Section 8 companies), PAN, registration certificate, audited financials, list of activities.

Key conditions for 80G eligibility:
- Income must be applied solely for charitable purposes (not religious only).
- No part of income should benefit any specific religious community (except broad human welfare activities).
- The entity must be registered under Companies Act 2013 (Section 8) or as a trust or society.
