Unclaimed ITC in GST assessment

Dear Experts,

I my friend has received ASMT- 10, for the FY 2017-18. Reason, there is short sales reported in GSTR 3B as compared to GSTR 1.

Also he has not claimed ITC of some amount in his GSTR 3B but the same is showing in GSTR 2A.The ITC amount is more than the tax liability on under reported sales in GSTR 3B.

He has surrendered his GST Registration after filing all the Returns.

My queries is , whether he can claim the Unclaimed amount of ITC under this Assessment.

Thanks and Regards.

Quick Summary
A user's friend received a GST assessment notice for FY 2017-18 due to discrepancies between GSTR-1 and GSTR-3B sales, and unclaimed ITC appearing in GSTR-2A. Although the unclaimed ITC exceeds the tax liability on under-reported sales, and the GST registration has been surrendered, the user is asking if this ITC can still be claimed during the assessment. The consensus from experts is that the unclaimed ITC cannot be claimed, and the short-paid tax must be discharged via DRC-03 with interest.

No he can't avail the ITC

no there is no way to claim the excess ITC. short paid tax is liable to be discharged through DRC-03 with interest now.
