Tuition Fee Reimbursement

I have claimed deduction of Tuition Fee paid for the education of my children under Section 80C of Income Tax Act during the year 2008-09.  As Sixth Pay Commission has introduced a scheme for reimbursement of Tuition Fee for two children (maximum upto  Rs.12000 per child) w.e.f. 1.9.2008,  Can I claim the reimbursement of Tuition Fee as there is a doubt that both the benefits i.e claiming deduction  U/S 80C of  Income Tax and claiming reimbursement of the tuition fee paid, can not be availed simultaneously?

The deduction is available on actual payment of tuition fee. In your case, the amount is not paid from your pocket and the benefit of Income tax is not available to you.

My question remain unanswered. My question is whether both the benefits i.e. deduction under 80C for Tuition Fee paid  and its reimbursement can be availed or not ?

You will have only one benefit either to avail the deduction u/s 80-C or to get the reimbursement. Both the benefits will not be available.

Where is the provision that at a time only one benefit i.e. either deduction u/S 80-C or getting reimbursement can be availed and both the benefit can not be availed.
