Trouble during articleship

Sir i am article in a firm where i have joined articlesip around 6 months back. I have completed 1year 1 month artcleship. But now my pricipal have started causing trouble. I had taken leave for one day and that too for the reason that i wanted to collect my gmcs1certificate as i did it from another city. So for that reason i took a leave. Due to this my principal behaved weardly and told me not to come office again. After this i requested a lot to my pricipal to forgive me. I sent many appology mails and made calls to apologize but still they didnt agree to call me back to office . even i have not got any stipend after joining this firm. On top of it working hours of the firm in a week is more than 42 hours. And the pricipal always behave very rudely and in a inhuman manner with all the artcles. Now i want to know that on the basis of all these grounds can i take transfer from this firm within the same city. Also as a proof of non payment of stipend i just have my bank passbook but have not maintained any workdiary. Doing this kind of articleship is blankly a mental torture. I want to know if i can take any valid action against them

Also i want to ask that is taking one day leave on a genuine base can be counted in misconduct or not as i fear that my principal can complaint against me on the basis of misconduct and is it true that our institute always support CAs and does not favours articles

i must say once again go with any senior person to that CA, talk to him and make him understand... if he didnt agrees... do write a letter with ur bank pass book details and all other details like mail copy to the inst..

M sure ICAI wil take suitable action in this regard

nothing like that shruti... its not a misconduct... nor anything like that icai favours members... we all members are with u in this case ....

Sir i have tried a lott to convince my principal. Also without maintaining work dairy can i make complaint for non payment. Thank u sir

ya you can do that...because u cal clearly write ur ca doesnt allow any work diary in ur office.. try to convenince any article if he or she can support you shruti.... go ahead....

Surbhi The Circumstances You are in is oppression.When a person gets oppressed in Life He has two options bear it and second Revolt against it if he/she has the option For.

You Really need not worry as there is a way out in our situtaion.You just need to take the First step to get out of here and God Will make Rest very easy.So be brave and Take the Step.

Remember God is always With oppressed no matter how strong the opressor is.

Now Firstly i ask you to take step back and Contemplate on your situation.

Make a Right analysis - The Reason am asking you to do this is because you have to continue CA and some how make a way out of this Firm and its possible.There may some ways which you cannot take as it might hamper your CA Progression like Filing Case,getting into some Controversy - not Required.

I will Firstly suggest you to Find a Firm in your City which has a branch in another City.So that you take a transfer in the name of another city due to fake reasons of your parents moving there or something( a lie to avoid your principals tyrrany).

If the above is not Possible,

As Mr Ganeshan Suggested After Analysing make a File with your contentions ,visit your nearest branch of ICAI,Speak to the Concerned President of the Branch.See if He is able to REsolve issues.

If not make a Written application to him Requesting on your Case of transfer,make an application to Concerned Regional Branch of ICAI with appropraite Procedures and keep copies of acknowledgement with you.

If matters Dont get Resolved ,Consult a Lawyer.
