can a tested party be a foregin associate enterprise of the assessee??

no they cannot be said as associated enterprise of the assessee,as per the definition of associated enterprise u/s 92A there is no mention of such kind of relations
Yes. A foreign AE can be a tested party provided it is less complex than the assessee itself.
