Transfer of Immovable property - Registry still not done by builder

Dear Sirs,

If any one has booked a flat in apartment and make full payment  Rs 58 (flat cost 52L + GST 6L) to the builder..... still flat under finishing stage and possession not given... OC not received and Registry not done. Although earlier buyer had complied with TDS formalities (as flat cost is more than 50L)

my question - if that person wants to  sale or ask builder to transfer such flat to third person Rs 58L (on the price of what earlier person had paid to builder).

What will be implication on part of TDS or Income Tax compliance ?

Allotment letter must haven given by Builder. That is sufficient in such cases.
