hello der, can ne1 tell me if the new rule of restricting inter city transfers has been revoked or appealed..only i heard it from one of my frnz..

But problem is that its not allowing...

One of my frnd (sorry dnt wanna disclose d names), was having only 2 hours articleship. She just used to visit her office, chitchat with other trainees, and come back home... She wanted to transfer in somother office, atleast to learn some basics only... Her boss asked ICAI for such transfer, which was denied by saying, "on the grounds of leatrning new, transfer is not allowed."...

 

And m disgraced that due to such happenings,. students are forced to go for dummy or some fake articleship, i.e they r registered in some office and workin in any other....

DONT ALLOW TRANSFERS SO MUCH

BUT INSTITUTE CAN MAKE A RULE REGARDING THAT ONLY 1 OR 2 TRANSFER CAN BE TAKEN OR SOMETHING LIKE THIS..

Respected Sir, The same above given reasons r faced by me even... i hv completed abt more than 2 yrs of articles ... but i did not got any exposure on corporate sector... n as u r aware sir, in 2day's economy u will b thrown out of market if u r not aware of coporate sector... i was planning 2 take transfer after my final exms in june 09... but in march itself ICAI kept probhibition on transfer... now u say sir hw can i get exposure abt the corporate sector.... the place where i m working dont hv any corporate files... and after being CA if we dont hav sufficient knowlege abt the facts n figures of corporate v will b fired 4m ur boss or seniour that even after being ca u r not aware of such simple thing... sir.. this kind of problem exists in the market...

plz give me some favourable advise so that i can hv better exposure...

Exposure is a problem. But I think ICAI is of the view that you have to decide it at the begining when you will join any CA firm. I remember the time of my articleship when someone comes to our office to learn the accounting and other stufs and when he get trained he left our firm. So most of the articles are of the view not to teach these people, as we have to clear all the mess created by them. Thats the same case with articles, when a article join a firm he/she doesn't know anything but when they get trained either they talk about the more exposure or work burden.

 

I think this is the case with all the students. You do not get exposures in the every field. Because there are very few firms in India who have all types of work. And even in big firms there are separate deptt. for every sector and when you join one sector you will be fixed in that area to  prodecue qualitative work.

as u urself told sir.. that every firm in india do not hav every kind of work.... hence dont u find it necessary 4 icai 2 allow atleast 1 or 2 trasnfer... fine they may demand 4 genuine reason, consent of principal..etc... but it is necessary 2 allow 4 transfer ...

sir, i have started my articleship on 24 april 2009 and till today i.e 4 july 2009, I have'nt got my stipend,so plz can anyone tell me what is irregular payment of stipend?

Based on my present situation can i take transfer or should i wait?if yes, then what is the way  to take transfer?

hi sir,

Can anyone tell me what is irregular payment of stipend?i have started my articleship on 24th april 2009 and till today i.e 4 july 2009 i havent got my stipend. Can i Take transfer on the basis of my present situation? If yes then how?or should i wait till t goes beyond a certain limit.

Hello Ritesh,

The ICAI considers the minimum stipend as Rs.1000 or Rs.750.
Now, Suppose X an Articled Asst. gets Rs. 2000 as stipend and he is serving his principal CA Mr. A  for 8 months and has received stipend only for 2 months i.e Rs 4000 then he can claim a tranfer on this grounds only if he doesnt receive stipend till his 10th Month.
If he is not receiving his stipend for more than 6 months then he can put up the matter before the Jury.

Hello Tilak Sir,

I would list all possible reason as to why students are right in opposing this transfer ban.

1. Students have the basic right to choose their principal. They should have the right to choose their principals. Now someone would say, that yes u r r8 as a trainee..u should have that right but if u go in the corporate sector , u have to face & tolerate every kind of bosses..Agreed, but there also u get the right to leave the company if u r really feeling that its not ur cup of tea to work for him anymore.(Of course, after paying monetary compensation for that )..But because of this rule we can not take transfer at any cost.

2. Students expect much more from this course. I tell u when one passes CPT, he gets impressed & satisfied with the high standard of learning set by ICAI. One starts expecting the same level of high standard during his training….& it is justified also…Think of a  typical student who has studied different subjects like costing , IT, A/c, Law, Computer Training & many  more. When he has acquired the theoretical base of different areas, he would also expect that he gets an opportunity to learn all these what he has been studying since last 2 or more years. And   when ICAI has made the training period of 3 years (3 yrs are not a small time) of training. Of course student would feel that he would get the opportunity to learn what he has been studying.

3. Look at the minimum stipend that ICAI has set up. I don’t know it relates to which time frame (This stipend rates are justified, had it been 15 yrs ago)…Take a particular case & try to understand what I mean to say.

Take a case where a student who has cleared his PCC & going through his articleship.He has already completed 1.5 months articleship.

Take a case where a student who has cleared his PCC & going through his articleship.He has already completed 1.5 years articleship.He might be getting more than minimum rates prescribed by ICAI….lets say 5000pm . Now, one of his colleague, who is just a M.com pass students working since last 5 years in the industry in the same field lets say accounting….gets 15000pm.Even though an article has more knowledge than him & sometimes he helps his colleague in work field.

How that article  must be feeling when he compares his meagre stipend for the same work done in a much better manner than his colleague….who just doesn’t possess not even 50% of the knowledge which he has acquired with his all days hard work.

Forget that, its really difficult to digest that after clearing CA Final or after Completing article ship(depending upon the persons' skills), u immediately get a very good start in ur career..But when u look back, u would realize that this is the same kind of work which I have been doing since my articleship for which I was paid a penny!!!!Exploitation to such an extent of your skill…how is it justified…Even if ur principal however be good  & pays u better than other competitive firms, then also it would be  far below than what an article deserves…Kahi na kahi aap ko ye baat zarur hurt karegiki yehi  kam  jiske liye aaj muje itna accha reward mil raha hai wohi kaam maine 2 saal(kyunki 1 saal sikhane me jaayega) kiya aur vo time pe muje kya chavanni milti thi.

While giving above example,the following assumptions are to be made by readers so that the example represent the realistic situation:

1.The firm is a local mid-size or small firm....NOt a big>

2.The firm has a specialisation inlets say 2 areas lets say, Bank audit & internal audit & some sorts of TAx filing etc....

3. THe article is on an average performs at par with other employees...MIght be slightly better.
