Tranfer/Termination of Articleship

In my View students ICAI should make a rule that a CA under practising should not keep or force the article student beyond his time limits.so that he/she can prepare for the Exam.If our institute is strict against transfer then our institute should also strict in working hours of Article Assitant.I dnt knw whether I am right or wrong but what i think is most of the stuudents fails IN CA bcoz under whom they are doing Articleship force him to work beyond working hours & he/She wont give minimum holidays for studies.Sory sir,there are some gramatical mistake,sory i said against you.

If u can favour a Articled Student better Give a Advice to our institute that dnt do anything oneside,if they want to do ,do on both side, I mean to say Termination not posible only if Article student are not allow to work more than working hours.

sir we dont compleaint agst our principal's bus we r jst say tht ki inst.. ko student ke baare me bhi kuch soochna chaiye....

in case if a student get better opportunity in other firm which is better for his future in tht case if student take transfer is not bad condition acording to me.........

like after completing pcc with gud marks, student wants to go articleship in any of the big firm in there city .....but his principle not give transfer to him than wat ths student doo ....tell me sir........

Its not only the case that students in the small firms are complaining, even students in the big firms are also complaining. Only the case is different.

Small Firms - Students don't get much exposure, so want to move to big firms.

Big Firms - Students feel much pressure of job. Don't get emough time to study.

May be my view are incorrect. Please correct me if I am wrong.

Please give your view in details about what do you wants from your principals and what from ICAI.

Sir, with all due respect, has ICAI assumed the authority to decide what is best for us? is ICAI unwilling to let us make choices and face the consequences? Give me that chance. my principal even made me to make calls for his bank call center. but to whom do i complain? no longer ICAI. cant i have the right to choose my destiny?

This stupid rule had been framed by the ICAI, just to show how serious are they in doing just for nothing

ICAI is the ultimate authority to take judgement/decision to run this course. They have the ultimate power to make rules in favor of students and members.

Please remember one thing that all the faculty members of ICAI are CAs and they had already gone through this articleship. Thats the reason they can understand the need of this articleship and how the students can get best out of it. May be one of you will became faculty member of ICAI in future then you can understand it better.

In my view, there is a difference when you are on deciding seat and you have to take decision and when you are on the other part.

Sir, precisely that. There is need for good articleship but ICAI has actually curbed our right to have it. Sir, people are getting dummy from members of the ICAI only. why are the doors being closed to those who genuinely want to do articleship from good firms? When we pass CPT, CAs in good firms tell us we are not qualified for articles, (People still make it to good firms on "recommedation" - sad) but now when we clear PCC, ICAI tells us to keep quiet. Sorry, we cant. :(

I think the reason behind this is that because students are taking so much transfer within the city just due to normal dispute with principal or may be they don't like the working environment in that firm or even to take dummy seat from other firm. Previously transfer was admitted in almost all the cases, thats the reason ICAI comes with the new rules "not to allow transfer in the same city".

I think all the excuses, reasons, complaints given are bit correct, but i think ICAI should allow transfers in certain cases.

Rather than imposing it, ICAI should try to restrict it................ on genuine reasons atleast they should allow the transfers...

Sir, but then it is convenient to oversee the fact that dummy cannot be bought in a shop. Members holding the prestigious CA degree are only betraying their alma mater. I dont want a dummy. I want to work in a reputed firm. end of request. I am not making low stipend an issue - which ICAI actually should realsie that people having money would go to college and B-school and not necessarily come for CA.

If ICAI really wanted to make a positive change, then it should have taken away the membership of Such CAs and cancelled the articleship of such articles which it has "come to note". Gross oversight on the part of ICAI - ICAI is allowing the profession to rot by not doing so.

This rule does not affect new dummy articles or those who are already have dummy. Just some students with sincerity whose agony is being worsened.

If you will complaint against any CAs who has given the dummy seats to articles, ICAI should take action against him. Its sure. But there should be someone who needs to complaint to ICAI.

Yes, you are correct that ICAI should allow the transfer in the genuine cases.

I am an article triainee. I know the institute has made such rule to curb the dummy. But after this rule of transfer has come to effect my principle has become quite secured that now the articles are left with no choice and now they have to continue under him only till their articleship gets over. So instead following the rules of ICAI , the articleship timings have instead increased. The timings are now from 10-8. Also no attendance register is maintained to give the credit of extra hours worked. Since last 3 weeks no weekly off i.e. Sunday. Threats and harrasment as well as abusive language. Now in this case you suggest me that you being a practising CA what are our the rights of we articles?  We articles feel like we are literally SLAVES after this rule.

We feel like that ICAI is british government and we articles are poor Indians.

I personally feel like i quit my articleship due to such increased harrasment.
