AND

In the Matter of: [Your Name / Company Name], having its principal place of business at [Your Address]. (... Applicant)

MOST RESPECTFULLY SHOWETH:

To, The Registrar of Trade Marks, The Trade Marks Registry, [City Name].

Subject: Response to the Examination Report dated [Insert Date] regarding Application No. [Insert Application Number] for registration of the trademark "[Your Trademark]".

Sir/Madam,

With reference to the Examination Report containing objections under Section 11 of the Trade Marks Act, 1999, the Applicant begs to submit the following response for your kind consideration:

1. Visual, Phonetic, and Structural Dissimilarity

The Applicant’s mark "[Your Trademark]" is visually, phonetically, and structurally completely different from the cited conflicting marks mentioned in the Examination Report (e.g., "[Mention Cited Mark 1]" and "[Mention Cited Mark 2]"). When looked at as a whole, there is no likelihood of confusion or deception among the purchasing public.

2. Difference in Goods and Services / Channel of Trade

Although the marks may fall under the same class, the actual goods/services offered by the Applicant are vastly different from those of the cited marks. The target consumers, trade channels, and marketing streams are distinct, eliminating any possibility of commercial confusion.

3. Prior and Continuous User (If Applicable)

The Applicant has been using the mark "[Your Trademark]" continuously and uninterruptedly since [Insert Date/Year, e.g., 2022] and has built significant goodwill and reputation. [Attach invoices/website screenshots as evidence, if available].

4. Distinctive Character

The Applicant’s mark is inherently distinctive and coined/arbitrary with respect to the goods/services applied for, making it fully eligible for registration under the Act.

PRAYER

In light of the above submissions, it is most respectfully prayed that:

  1. The objections raised under Section 11 of the Trade Marks Act, 1999, be waived.

  2. The Application No. [Insert Application Number] be accepted and advertised in the Trade Marks Journal.

  3. If your learned office requires further clarification, an opportunity for a personal hearing may kindly be granted to the Applicant before passing any adverse order.
