Termination of articles after 3 years???

Hello Guys,

I see that you are all up to date with the rules and you know exactly how the ICAI reacts to certain issues.

I have passed CA inter examinations in 2007 and completed 9 months of articles in India. After that i had to relocate to the United States and could not continue. As i thought I will never return to India, i never terminated the articles with the Principal which i must have done in May 2009. My question is if i can do it now after almost three years. I know there is a fine amount for that but i do not know if it can be done even after three years. I want to terminate it now and start my training with another Principal.

Please let me know if I can terminate the Articles now which should have been done in May 2009.

Also, assuming your Principal agrees for your termination, then you may need to fill Form 109 in triplicate (all in original) to be sent to concerned Regional office, your Principal office and keeping last one copy with you. In case, the Principal is not accepting for the termination, then the student can herself terminate the articleship by filling Form 120 (in place of Form 109). Usually, Forms should be submitted in one month whether in case of registration/termination. In your case as the form submission is delayed, write a condonation letter and accompany that with late fees. Late fees details can be accessed from below link (I hope this is the latest copy). In your case I guess it is 1000/-.

Oh Krishna,

Thank you so much for all your help/advice. Here, in this place not many Chartered accountants are aware of this training and not even willing to be the principal. I am finding it very difficult to find a person who will be willing to act as my principal. I am trying to find people through linked in. Hoping for the best.

Regarding termination, i am yet to start the process. Assuming i find a principal and i successfully terminate my previous articleship, should i pay the registeration fee all over again when i re- register?I know its a long way. just wanted to make sure if it will cost a lot to go through this process.
