Tds u/s 194a

As per section 194A TDS is to be deducted @ 1% on sale consideration. But this section is not applicable if seller give undertaking.
My question is if we pay tax(TDS) under 26QB . now seller provide us the undertaking not to deduct TDS. how can i get it reversed?

194A is for interest other than interest on securities
it is 194ia
1% TDS must when consideration above 50 lakhs

Srry for wrong section quoted its 194IA ,     but thats not my query..... please resolve my query

Section does not provide for any such undertaking

That means Buyer has to mandatory deduct tax at source, where the consideration exceeds Rs 50 lakhs???? 
Irrespective of the facts that seller provide any declaration??   or A.O certificate??
