Dear Friends,

please share

1.whether state govt departments are required to comply with TDS Provisions.

2.If such department has failed to file TDS return for F.Y.2008-09, Though TDS had been deposited in time (ie.before  31march 09).

3. what is the solutijon to above?

4.Can we file tds return for2008-09 in dec 2009.

5.how to be reported above failurein Statutory Audit Report.

it is real problem facing by me

Q1.whether state govt departments are required to comply with TDS Provisions.
A1. Yes, State and Central Government also need to comple with TDS.

2.If such department has failed to file TDS return for F.Y.2008-09, Though TDS had been deposited in time (ie.before  31march 09).

3. what is the solutijon to above?
A3: Especially in Karnataka, BESCOMM in not following the procedure of Filing TDS Quarterly, but they have been depositing the payment into Income Tax account. We have reminded many time with department there were not action taken on it. What to do it is our money we can’t ignore to avail the TDS.

 

4.Can we file tds return for2008-09 in dec 2009.
A4: You can file TDS Return.

5.how to be reported above failurein Statutory Audit Report
A5: Even I not in a position to understand how the Auditors are auditing such Government Department, and disclosing them in audit reports.
