can i claim tds refund of filing ITR FY 2021-22 under section 139(8a) updated return now?

No. Updated return cannot be filed in case of refund claim.
You can file return u/s. 119(2)(b) of IT act, after getting condonation for not filling return from you Jurisdictional ITO.
