03 December 2009a party has deducted TDS 0f Rs 6000 and paid to the govt in f/y 08-09.Party has not informed to the company and company has not taken the benifit of TDS in his return and paid tax accordingly( without taking benifit of Rs 6000). now how company can take benifit of TDS paid in last year...reply

The Company must file the revised return and claim for Excess TAX paid. The revised return must be file within one year from the end of Assessment Year.

company can revise the return if company file the original return within due date
and get refund of rs. 6000/- otherwise decline.

Yeah company can revise return if filled in time and take d refund and would hv 2 letgo TDS Receivable if return not filled in time...

Dear,
I would advise not to revise the return if the amount is not substential for the company as the revise returns often becoms a victim of Scrutiny(often scrutiny cases are opened only on the basis that the said returm was revised as income tax people suspect that there would be something materially wrong in the same)
This is totally practical view.

Both the company as well as Party revise the return.
