If You are under the TDS deductible provisions then You must be deduct TDS as per requirements of acts...
But party said that he's not want to deduct tds and pay reverse Charge...

GST & Income Tax both are different and do not confusing with TDS matters...

Better to follow provisions, not for party's guidance...
RCM concept/rules is under GST.... TDS concept/rules is under Income Tax... Both are different taxation as IDT & DT. No more questions if provisions applicable...
TDS needs to be done by the person making payment since it gets covered u.s 194C of the IT act.
