What will be the implication of Tax Deducted at Source Overseas on Export of Services back in India. I mean, in simple words that can we get Refund of TDS of Overseas back in India in the event of Tax Liability of a Company NIL, if not so then how that sort of TDS will be treated in Accounts in India.

Hi Depen,
In case of export of services, the entity to whom we are rendering the services, will pay the amount after deducting the TDS and later will be sending the TDS certificate which can be reduced from Indian Company tax liability. In case The company doesnt have any taxable income, the amount of TDS deducted will be received as refund.

No, The amount of TDS deducted outside India cannot be claimed as refund. It can be only be reduced from Indian Company tax liability.
