PLS LET ME KNOW THE DOCUMENTARY EVIDENCE FOR NOT DEDUCTING TAX AT SOURCE ON SERVICE TAX ELEMENT..

tds is on gross amount including service tax

There is no documentary evidence but for the safer side we should deduct TDS on gross amount.

TDS should be deducted on gross amount as the credit is made for whole amount in the creditors' or deductee account and thus is in accordance with IT Act,1961.
