12 February 2015china based pharmaceutical company registered pregablin api in china produced by our indian based company.so indian based company needs to pay registration service fees(5000 USD ) to china pharmaceutical company for its services.my doubt is.....
1 is tds applicable on it?
2 if applicable,at what rate?
3 implication of DTAA provisions on it?

I Think TDS is applicable on service charges remittance to china. Its come U/s 194J Rate of tax 10%
If have pan no other then rate of tax is 20%

i heard somewhere,tds rate applicable is 25.75% as that china company has no pan in India.can any one please clarify on this
