TDS on sale of immoveable property

Hello All,

I have recently sold my flat, the sale consideration of the property exceeds 50L. Buyer of flat has given entire amount to me and he did not cut the TDS amount.

Is it okay if I pay TDS(26QB) on his behalf?

Yes, it can be done.

Otherwise, you will need to give him proof of the assessment (i.e. the deal offered to tax) of the capital gains paid, by way of CA certificate.

Capital gains is a seperate issue and issue of tds certificate is a seperate issue.

If there is only one buyer and one seller, then you can pay on his behalf.

Yes, you can pay the TDS (Tax Deducted at Source) on behalf of the buyer of your flat through Form 26QB.

I am the only 1 seller, in agreement for sale as a buyer there are names of both husband and wife I hope this is considered as only 1 buyer.

2 Bodies 1 Soul is not existent in tax laws.
