Tds on salary

Dear Sir / Madam,

 

One of the new joined employee earned salary Rs. 3 lakh for six months & he is under TDS limit. But, Can't give his previous employment details. Bcoz, The previous employer not give any details to him for the reason of not give releving & notice periods...

What can I do now...?

when he joined in new company ? slaray received from previous employer is to be taken into account when employee joins in yr company during the year.  FY 2019-20.  suppose he joins in as on 1.6.2019 then salary received and tax deducted on this  salary from 1.4.19 to 31.5.19 is to be obtained by new employer and taken into account and tds deducted in new company accordingly. if employee not able to provide then you may ignore salary and tds from previous employer

If the employee can't provide previous employment details then You can deduct TDS as per Your payments...

new company is not liable to check if incoming employee has provided the income details of his previous employment.
if available then current employer need to consider it and deduct tax .if unavailable then no need to deduct tax

If Salary exceeding the the limit then new employer also liable to deduct TDS...

It is not obligatory for the new employer to obtain Income and TDS details provided Form 12B is obtained where the employee has not declared any income from previous employer.

However, If he has declared  income from previous employer and if combined it exceeds BEL, then it is obligatory for the new employer to factor previous employer income and TDS deducted for the current FY income and tax liability.
