TDS on Salary

Please Help Urgently..

Employer has given bonus to employee after deducting TDS. Now due to some issue employee is leaving job. Now he(Employee) wants confimation that What if Employer refuse to give Form 16. What will be the situation if employer say in future that i have not deducted TDS on payment made to employee. How we can prove that employer has deducted TDS on such amount. Employee is not having any proof of such Bonus calculation as it depends on employee performance.

If any TDS amount have been deducted then it is right of an employee to get TDS certificate (form 16) from employer. If your employer does not provide the form 16 then you may complaint to the Income Tax Dept./

Thanks Rajesh but my Further my Question is How will Employee prove that they have deducted TDS as employee has received bonus as per their performance which is not shown in there salary structure.

if you have received salary by cheque its prove to itself.

TDS can be claim in return so Income tax officer issue a notice to company to give detail for that. he will take an action ton company. if TDs not deposited by company, company may be lible to pay Tds and penality. its responsbility of a company to deduct Tds from Employee.

what if employer lie that (even after deducting TDS) i forgot to deduct tds. What we have to do in that situation. 

Just file your IT Return and claim refund of TDS (if any)
