Is TDS applicable when the services are recieved in a foreign country(namely UK) by an Indian company trough a foreign Agent.The payment is being made by the Indian company.The nature of service are marketing services.Is TDS deductible on the services.what rate the TDS is deductible at??

DEAR ANKIT,
IF THE STATUS OF FOREIGN AGENT IS NON RESIDENT OR RESIDENT AND NOT ORDINARY RESIDENT, NO TDS WOULD BE DEDUCTIBLE AS THE SERVICES RENDERED OUTSIDE INDIA AND INCOME RECEIVED OUTSIDE INDIA. IN CASE OF NON RESIDENT OR RNOR, IF INCOME ACCRUES OR DEEMED TO ACCRUE OR RECEIVED OUTSIDE INDIA, IT WILL NOT LIABLE TO TAX INDIA..
