TDS notification postponed to 1st July

PRESS RELEASE

The Central Board of Direct Taxes have decided to defer the implementation of Notification No.31/2009 dated 25.3.2009 amending or substituting Rules 30, 31, 31A and 31AA of the Income Tax Rules, 1962. The amended / substituted Rules will now come into effect on 1st July 2009 instead of 1st April 2009.

Tax deductors / collectors may continue to deposit TDS / TCS tax and file TDS / TCS returns as per the pre-amended provisions in the interim period.

Not for all the deductor/depositor.

Company and person falling under section 44AB for auditing their accounts need to make e-payment.

Whether we have to pay interest on delayed payment ????????????

This was definitely on the cards. It was simply not possible to comply with the new requirements of TDS without adequate clarifications from the Department. If this requirement would not have been deferred, that would have lead to unnecessary hardship and haressment to the taxpayers. Lets hope next time CBDT will issue exact guidelines for the procedure to be followed for compliance of this TDS Notification before it becomes effective. Right now the Department itself does not have the mechanism to handle it.............leave alone the taxpayers.
