TDS NOT CLAIM IN RETURN

Tax queries 197 views 1 replies

I had filed income tax return of my pvt ltd company for FY 2013-14 where in forgot to claim TDS on works contract execute by us. Our firm got under scrutiny assessment . Hon A.O. assess our case without giving us credit of TDS which was not claimed by us in return . According to him , Assessee is not allowed to take benifit of any TDS/ Deductions , if the same is not claimed in return.

Now My question is that , Is there any possibility to reclaim the same TDS credit which was mistakenly not claimed by me in our return and not allowed in assessment.

You have to go for rectification under 154 or file an appeal. The AO is right in stating that TDS has to be claimed on refund. But AO has also powers to give TDS credit for TDS left out to be claimed in ITR
