TDS issue Clarification [Subcontractor]

 We have a Ltd company based in mumbai providing underwater diving services.

 

Under a contract we are working as a subcontractor for a party based in india . Our agreement is a subcontractor agreement

 

Under this subcontractor agreement we are providing them with with diving equipment and personnel who do underwater diving jobs.

 

What is the rate of TDS that should be deducted for hiring of equipment and for providing personnel on day rate basis.

 

will this be covered under 194C or 194J

what is the list of profession covered under professional or technical category

TDS applicable U/s 194 J.

If the payee is providing you the diving equipment and personnel to do the diving and himself runs the equipment at his risk, the entire income will fall within FTS u/s 194J. However if the equipment is given to you (leased with VAT as applicable), then the renting of equipment will be under section 194I and the provision of Technical persons for diving will be u/s 194J (Fees for Technical Service).
