my client have not filed ITR for Fy 19-20 where tds deducted was 40000

can I claim it's now in fy 20-21 ITR

If you are having any refund after deduction of income tax for F.Y 19-20 , then you have to take approval from CIT for filling ITR of F.Y 19-20 , under condonation of dealy . after approval you can file return .
