Tds deducted rate applicable by bangladesh client

Dear Sir,

We are providing technical service from India to our Bangladesh Client and we will not form any PE in Bangladesh. The services are IT enabled so it will be operated from India. Client told us that they will deducted TDS @ 20%. My question is -

1. Whether TDS rate mentioned is correct?

2. Whether the TDS deducted in Bangladesh will be eligible for credit in India?

3. Documentation required for th same?

Thanks in advance for your advise.

Regards

Ajay

1. Not sure where the 20% is coming from. Ask your client to provide relevant clause of India-Bangladesh DTAA.

2. Yes, you would be able to claim the credit for the tax deducted.

3. Your client will provide you with the details of the tax paid against payments made to you
