Write a letter to your TDS ward officer to correct the mistake made and state the mistake made by you while making the payment.

ok  thank you sir. let me try this.

Hey do tell me if TAN No qouted is wrong then what can I do to correct the mistake??

Please reply.:-)

Thanks & Regards,

Pooja.

Dear Aditya Sir,

Sorry bcoz i didnot followed your process,

I just approched the Bank clerk and told him, what had happen with me.

He advised me to give a new TDS challan filled properly this time, also an application in which i took all the  liabilities regarding any mistake in future or any mislead on behalf of the TAN owner.

after that they corrected that and i got new TDS challan ack. and this time everything was fine

;)

Dear Pooja,

Just go to the Bank and ask them to rectify the mistake. hope they will help you out.

;)

Thanks sir..

I will try it out.

When I was checking all the deductee PAN for F Y 09-10, I have come to know my mistake that I have treated Partnership firm as Individual and I deducted and deposited the TDS @ 1 % in place of 2% as per u/s. 94C.

 (E.g. Rs. Bill 101000.00-TDS 1000.00=Net Pay 100000.00) @ TDS 1%

 But correction must be

TDS u/s. 94C for Partnership Deductee is 2%

 (E.g. Rs. Bill 102000.00-TDS 2000.00=Net Pay 100000.00)

But we have already filled the Audit, Annual ITR and Annual TDS return. Now see the above circumstances, our TDS liability accrued and may be AO will disallow and impose the penalty with taxes for the non deducted Bill Amount and we will have to pay the Tax at the time of scrutiny.

So how can I rectify the mistake and save the tax & penalties

Dear Malhotra, A Stitch in Time Saves Nine.

1. Just calculate the amount of short deduction, add up-to-date interest in that as per applicable rates, and deposit the amount in government account - soon.

2. File a correction return for that quarter amending the mistakes.

3. Pass the entries in your current books as per the actual dates now - "Being the amount of short deduction of tax on  (date) from the payment to (name) recompensed now with interest".

and Sleep.

dear pooja

Approach your ito and submit a letter  stating the fact that tan is incorrect.

regards
