Dear Sir,

A resturant located in a mall and entered into an agreement with an agency (with the help of bank) to pick up daily closing cash from resturant and deposit in bank account. Whether TDS on Service Charges for Handling Cash, to be deducted u/s 194C or 194J???

Hello Sonu,

The type of services that come under the purview of section 194J are services with professional or technical nature i.e. they require application of specialised knowledge in their discharge. The service of picking up cash and depositing them in bank is more clerical in its nature, hence the agreement shall be treated as normal contract and shall come under Sec. 194C.

There is no professional skills required to perform the given services, hence TDS shall not be deducted under 194J but 194 C @ 1% or 2% considering limits of 30K and 75K .
