hello

one of my client is giving commission to any agent for getting orders now as per law he shd deduct tds. but that broker dont allowing him to deduct.

what can he do? can he show any other exp to this? or he shd deduct

pl help buddies

Dear Kamlesh,

 

You can tell your client to explain the agent that he (ie. the agent) can claim the TDS from the TDS Certificate (Form 16A) issued by the client in the Income Tax Return.

 

If still the Agent does not agree then your client will have to pay TDS from his own pocket or else the commission expense will be disallowed.
