Dear Professional Colleagues,

I have on query,

One of my client has purchased one property from NRI. the property is situated in India and after indexation there is no Capital Gain arising to the owner (who is NRI). but now my client wants to make payment for the same.

Is TDS is to be deducted if yes at what rate??

I think no TDS shall be daducted as the capital gain is nill

Deduct 1 per cent tds if sale consideration is more than 50 lacks
Since there is no capital gain and therefore no libility of TDS under section 195 of the act
Deduct 1% tds if sale consideration is more than 50 lacks
TDS is not linked with the profit or gain. It has to be deducted based on the consideration.Hence deduct tax, if outside the ceiling
As per my opinion tds should be deducted.

As per my opinion, Section 195 is applicable for TDS for property purchased from NRI
