Taxable Income for Non Resident Indian

Dear All,

 

I am currently working on one of the files of my client who is a member of Ship Crew.

As per Section 6, in the case of a person specified above one should be 182 days or more to be claimed as citizen of India. 

My client has been NRI for last 4yrs i.e A/Y 11-12, 10-11, 09-10, 08-09.

He had income from Salary where TDS has been deducted without giving him any releif i.e allowance & deductions.

He wants to claim Refund.

What are the circumstances for filling the same?

Wether or not, he can claim deduction under chapter VI A

Salary is exempt u/s.10(6), hence no TDS should have been deducted, but if the deductor company is indian, then the TDS can be claimed vide filing return of income for refund.

 

But be sure that he is a non resident under sec.6, because the company has deducted the TDS...
