Taxability of Gratuity

One of client has served for 7 years, 2 months and 26 days. Wages last drawn per month Rs. 20912. And he has recived around 84k as Gratuity.

1. Is Gratuity received Taxable ?

2. If yes How much need to pay ?
And what are the conditions?

3. How to Know if the employer has covered under the payment of Gratuity Act or not ?

1.government employee exempted
non government employees taxable
non government employees covered under the gratuity act then
minimum of the following will be exempted
a. 10 lakhs
b.actual gratuity received
c.amount of gratuity an employee is eligible to received

non government employees not covered in gratuity act then the minimum will
be exempted
a . rs 10lakh
b. actual gratuity limit
c half months average salary for each complete of service

employees must be in continuation service of 5 year's with the same employers and the total employees strength of the employer shall be more than 10 members then they covered under gratuity act ..

what this meant by ?

In My case, Gratuity received is exempted or not ? And where should I disclose in ITR ?

Its means the amount eligible to receive

It is calculated   by (15* last drawn salary * tenure of working ) divided by 26

As per your case (15*20192*7)/26 = 81544.61

Or you say 81545 

Private ya public employees sir if you  government fully 

If private then the least of the above will extempted  

It shows under the head salaries the taxable amount 

And the exempted amount is shown in EI (exempted income) session of ITR

 

Mam, In my case lease of the following is

a) 10lakh

or

b) 84424 ( Gratuity actually received)

or

c) 81545. ( Gratuity is eligible to b received)



so as per calculation I should take lease of the following is 81545. Mam am I right ?


And I am fully confused Mam, thing is that people say that Upto 10lakh it is exempt ?

No sir that's not correct  means calculation is correct  but taxability not correct

And one this sir now it's become 20 lakh after amendment which is 10 lakh sorry for above I write 10 lakh for  employees covered under payment of gratuity act

So as per your case 

He gets  gratuity  84424

He eligible for 81545 

As per amendment iam taking exemption up to 20 lakh or as per previous says 10 lakh 

Our least is 81545 

Sir now you have to see is it crossing the exemption limit says 20 lakh or 10 lakhs  

No means no gratuity taxability  

But supposed our least crossed the exemption limit then the rest of crossing will be taxable
