Taxability of Capital Gains

Client has sold a property along with his sister. Now since sister is a religious nune doesnt want to file return in her capacity, wants to gift the same to her brother. Can brother include her share in his return of income? If yes under which head? Capital Gains or other sources? Her name has come in the Sale Deed. If brother already filed the return including her share what is the remedy available to the brother?

Brother can not include sister share in his return. Sister have to file her own return with her PAN.
