tax refund under DTTA

An educational trust has appointed a
foreign faculty in culinary subject whose country is having DTTA with India. His salary is paid in INR. Income tax is deducted from his salary and deposited as required. He has also filed IT returns here. Can he claim tax refund under DTTA and what is the procedure to claim the refund?

DTTA may be corrected as DTAA
Assuming that foreign faculty is not resident of India, he is not required to file income tax return in India. But like Indian Income Tax where we can claim benefit of tax paid or deducted in any other country with whom we have signed DTAA, I am assuming he can also claim that benefit while filing the income tax return in his country.

Thank u sir.In this case he has stayed in India for more than 180 days and he has confirmed that during that period he had no income source in his country..
Then in that case he is resident in India and is required to file income tax return in India by declaring all the income received in India..
