Tax on office penalty

I was fined Rs 8,000 by my office for a non smoking rule, from my salary. Is it included for my tax ? They deducted it directly from my salary. Please help.

yes, it is going to be part salary, as if salary once credited can not be waived

 salary can only  be waived to central goverment.

It was never credited to my salary. I just received a lesser salary for the month. No receipt also. Could you please give me a relevant section or law so that i can stand up to my company's accounts office :)

for your specific point there is no specific laws and regulations.

When they dont pay, why can they credit to your account & give receipt. 

what they did is correct.

Hello, You paid fine for breach of Rules and Regulations of your company.

You can not claim it as a deduction from your taxable income.

There is no specific section for allowing the fine as deduction from your total income.

it is breach of rules and for these type of mistakes we should not do in the premises and we shold bare all these exps on owr own

Salary is chargable on "Due" or "Receipt"  basis which ever is earlior.  

Your total salary is chargable on due basis from your employer.

Your employer is imposed the penality for no smooking rule and get it deducted from your salary. You have short receipt of income.

It only application of your income earned.

 

As for as deduction are concorn , only that will be deducted from your salary income which is specified in section 16.
