TAX DEMAND STILL SHOWING ON INCOME TAX PORTAL, EVEN AFTER SUBMITTING CONSEQUENTIAL ORDER

Dear CA FORUM for Income Tax

 

Facts:

  • Matter belongs to FY 2009/10. Tax returns filed on time.
  • Issue with assessment. Issues went to CIT appeals.
  • Got favourable order in 2017.
  • Department issued consequential order showing Tax payable as zero.
  • But there was a mistake in the calculation from the department, since consequential order should result in a refund.
  • Department in response to a grievant admitted to refund due in 2019, but no refund received since last 5 years.
  • Instead Income Tax portal showing a TAX DEMAND OF MORE THAN 10 LAKHS.

 

Please advise if there is a circular from Inocme tax department or govertnament of India which will help:

  1. Remove the outstanding demand from online tax portal.
  2. Get my refund.

This refund will help me immensely as this stage of my life.

Visit your assessing officer and discuss about the status of refund and outstanding demand

Mr.Sajjan Tawde and others - Now the department after consulting in person say that the ITR for the respective year is missing on their portal. The client successorts ( actual client has passed away ) also do not have it.  But they have the 26AS, appeal order copy, consequential order clearly showing demand as zero, and response to a grievance filed that a refund is due and that it is waiting for regional manager approval.

 

How to get the matter closed so that the online IT portal reflects no demand and shows the matter as closed ?
