T.d.s. refund for financial year 2012 & 2013

Dear friends,

My relative started business in year 2009 since than he didnt filed any ITR,

I just need a advice from u with regards

to TDS refund as his TDS was deducted as Rs. 89,000/- in financial year 2012 & 75,000/- in financial year 2013

Would like to know will he get the TDS refund after filing the all ITR's now in current year......

Yes, he will get refund if the TDS that is deducted is shown in 26AS of Income tax india website. He will only have to mention TAN No. of deductor, The year of deduction and the amount of deduction in the ITR form. However,under the new Circular, claim for refund of excess TDS needs to be made within a period of two years from the end of the financial year in which the tax was deductible at source. If you want to go in to the details then please see the Circular No. 2/[ F. No. 385/25/2010-IT(B)] dated 27 April 2011. .........yes

So he will get the claim only for 2 years.
