During the Processing of the Income Tax Return , Surcharge of 15% has been charged by the CPC in the Intimation. Total Income of the AOP is below 1 Cr. and No conditions are applicable for charging surcharge. We have filed many time for rectification but still it has been processed with surcharge again and again.
To resolve the surcharge issue, follow these steps:
Step 1: Verify the Return and Intimation Re-check the income tax return and the intimation received from CPC to ensure: - Total income is below ₹1 crore. - No conditions are applicable for charging surcharge.
Step 2: Gather Supporting Documents Collect documents to support your claim: - Copy of the income tax return. - Intimation received from CPC. - Computation of income and tax liability.
Step 3: File Rectification Request Again Submit another rectification request: - Clearly mention the issue with surcharge. - Attach supporting documents. - Request removal of surcharge.
Step 4: Escalate the Issue If the issue persists, escalate it to: - Jurisdictional Assessing Officer (AO). - Principal Commissioner of Income Tax (PCIT). - Income Tax Ombudsman. Step 5
